The short version.
AIDSTATION provides AI-driven coaching for endurance and multi-sport athletes. By creating an account or using the service you agree to these Terms. A few points up front:
- Our coaching is advisory, not medical. Talk to your physician before acting on training, nutrition, or supplement recommendations, especially if you have a medical condition.
- Your training plan is generated by AI. The AI uses your profile, training data, and goals to make recommendations. Outputs may contain errors. You decide what to do with them. We may also use your training content to develop and improve our own AI coaching models — details in section 8.
- Paid subscriptions auto-renew unless you cancel. We will tell you in advance and you can cancel at any time from inside the app.
- If we ever have a dispute, both you and we agree to individual arbitration instead of court, with a class action waiver. You can opt out of arbitration within 30 days of creating your account. See section 20.
- This summary does not replace the Terms below. The Terms govern.
Acceptance.
These Terms and Conditions ("Terms") form a binding agreement between you and AIDSTATION Pro, LLC, a Texas limited liability company ("AIDSTATION," "we," "us," "our"), covering your access to and use of the AIDSTATION website, mobile applications, APIs, and related services (collectively, the "Service").
By creating an account, accessing the Service, or clicking a button indicating acceptance, you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy and Acceptable Use Policy (each available at www.aidstation.pro and each incorporated by reference).
If you are entering into these Terms on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to both you and that organization.
If you do not agree to these Terms, do not use the Service.
Eligibility.
You may use the Service only if all of the following are true:
- You are at least 16 years of age. We do not knowingly provide the Service to anyone under 16. If we learn that an account belongs to a person under 16, we will close it.
- You have the legal capacity to enter into a binding contract under the laws of your jurisdiction.
- You are not located in, ordinarily resident in, or a national of a country subject to a comprehensive embargo by the United States Government, and you are not listed on any U.S. Government list of prohibited or restricted parties (including the Specially Designated Nationals list).
- You will provide accurate information when creating your account and keep it current.
- You have not previously been suspended or removed from the Service.
If any of these stops being true while you have an account, you must stop using the Service and contact us.
Your account.
3.1 Registration
You create an account by providing the information requested at signup. You are responsible for the accuracy of that information.
3.2 Account security
You are responsible for safeguarding your password and for all activity that occurs under your account. We strongly recommend a unique, strong password and enabling any multi-factor authentication options we provide. Tell us immediately if you suspect unauthorized access.
3.3 One account per person
You may not share your account credentials, sell or transfer your account, or allow another person to use your account. Coaches and athletes participating in team features each need their own account.
3.4 Account closure
You can close your account at any time from inside the app. Closure is governed by the deletion procedures described in our Privacy Policy and the in-app deletion flow.
The service.
AIDSTATION provides AI-generated training plans, exercise sessions, nutrition and supplement guidance, race preparation tools, and related coaching outputs for endurance and multi-sport athletes. The specific features available depend on your subscription tier and on the disciplines and goals you select.
The Service is provided over the internet. It requires a compatible device, an internet connection, and (for some features) connected third-party services such as fitness device platforms. We may add, remove, or modify features at any time, subject to section 15.
AI coaching.
5.1 How AI generates your plan
Your training plan is produced by an AI system using your profile, training history, goals, sport rules, exercise libraries, and (where you have opted in) sensitive data such as heart rate, sleep, and body composition. The system updates plans when your situation changes, including new performance data, reported injuries, travel, or equipment changes.
5.2 AI outputs are advisory
AI outputs are recommendations. They are not commands and they are not guaranteed to be accurate, complete, current, or suitable for your individual situation. You are free to follow, modify, or ignore any output. The Service is not a substitute for the judgment of a qualified human coach, physical therapist, sports physician, dietitian, or other professional.
5.3 AI outputs are not medical advice
The AI is instructed to refuse engagement on medical diagnosis, pregnancy-related coaching, prescription drug guidance, mental health treatment, and eating disorder management. The AI is a training tool. It is not a medical device, and AIDSTATION is not a healthcare provider. See section 6.
5.4 Known limits
AI systems can produce confident-sounding errors. Recommendations may be inconsistent across sessions, miss context, or fail to account for risks that a human coach would notice. Use your own judgment, especially when the recommendation conflicts with your body's signals or with advice from your physician or coach. If a recommendation seems wrong, flag it to us and stop following it.
5.5 No human review of every output
AI outputs are generated automatically and are not individually reviewed by our staff before delivery. We review patterns of output and feedback to improve the system; we do not pre-approve every plan or session.
Health, safety, and medical disclaimer.
The Service does not provide medical advice, diagnosis, or treatment. Information and recommendations provided through the Service are for general informational and training purposes only.
Consult a qualified medical professional before starting any new training, nutrition, or supplement program, and before continuing one if your circumstances change. This is especially important if you have any of the following:
- Cardiovascular conditions, hypertension, or a family history of cardiac events
- Diabetes, kidney disease, liver disease, or metabolic disorders
- Musculoskeletal injuries, surgeries, or chronic pain conditions
- Eating disorders or a history of disordered eating
- Mental health conditions including depression and anxiety
- Pregnancy or recent pregnancy (the Service does not coach on pregnancy)
- Any condition for which you take prescription medication
Endurance training carries inherent risks, including but not limited to muscle injury, joint injury, dehydration, heat illness, hyponatremia, cardiovascular events, falls, drowning, and death. Adventure racing, mountain sports, water sports, and similar activities carry additional risks of serious injury and death. By using the Service, you acknowledge these risks and accept full responsibility for your participation.
Stop immediately and seek medical care if you experience chest pain, severe shortness of breath, fainting, severe dizziness, severe muscle pain or weakness, signs of heat illness, signs of hyponatremia, or any other symptom that concerns you.
Emergency situations: The Service is not a substitute for emergency services. If you have a medical emergency, call your local emergency number.
Our separate Health and Safety Notice (available at www.aidstation.pro and presented during onboarding) gives a fuller description of the risks of endurance and multi-sport training and of your acknowledgement and assumption of those risks. It is incorporated into these Terms by reference, and the acknowledgements in it apply in addition to this section.
Subscriptions and billing.
7.1 Plans and pricing
The Service is offered on subscription plans whose features, duration, and prices are described at www.aidstation.pro and at the point of purchase. Pricing and features may change. Changes will not affect a billing period you have already paid for.
7.2 Free trials and promotions
We may offer free trials and promotional pricing. Trial terms, including duration and any conversion to paid subscription, are disclosed at signup. If a trial converts to a paid subscription, we will charge the payment method on file at the price disclosed at signup unless you cancel before the trial ends. Promotions cannot be combined unless we say so explicitly.
7.3 Auto-renewal
Your subscription will automatically renew at the end of each billing period for the same term and at the then-current price. We will charge your payment method on file on the renewal date.
- We will send you a reminder by email before any renewal at intervals of six months or longer, and we will send a confirmation when your subscription is renewed.
- You may cancel auto-renewal at any time from your account settings or by contacting us at help@aidstation.pro. Cancellation takes effect at the end of the then-current billing period.
- Renewal pricing may differ from your initial signup price. Material price changes will be communicated at least 30 days in advance with a separate notice giving you the option to cancel before the new price applies.
California residents: This subscription is governed by California Business and Professions Code section 17600 et seq. You may cancel at any time without penalty from your account settings or by contacting us. See section 21.2.
7.4 Refunds and cancellation
- Monthly subscriptions: Cancellation stops auto-renewal at the end of the current month. We do not pro-rate refunds for partial months.
- Annual subscriptions: We offer a 14-day refund window from the start of any new annual subscription term (initial or renewal). Cancel within 14 days and we will refund the full amount paid for that term. After 14 days, the subscription continues to the end of the term and is not refundable.
- Statutory rights preserved: If the law of your jurisdiction grants you a non-waivable refund or withdrawal right that is more generous than the above (for example, the EU Consumer Rights Directive 14-day withdrawal right for digital content), that right applies and is not affected by this section.
- Exceptional circumstances: We may issue discretionary refunds for documented hardship, prolonged service outages, or other circumstances at our reasonable discretion.
7.5 Taxes
Prices may be exclusive of applicable taxes (including VAT, GST, sales tax). Where required, we will collect and remit applicable taxes. Where we do not collect, you are responsible for any taxes due in your jurisdiction.
7.6 Payment processor
Payments are processed by a third-party payment processor. By providing payment information you authorize us and the processor to charge that method for the amounts due. We do not receive or store full card numbers. The processor's terms apply to the payment transaction. See our Privacy Policy section 2.6.
7.7 Failed payments
If a payment fails, we may retry, downgrade your account, or suspend access until the balance is resolved. We will notify you before any suspension.
Your content.
8.1 What you submit
"Your Content" means anything you submit to the Service, including profile information, training logs, workout files, photos, notes, ratings, prompts to the AI coach, feedback, and any content you contribute to shared databases. You retain ownership of Your Content.
8.2 License you grant us
You grant AIDSTATION a worldwide, non-exclusive, royalty-free, fully-paid license to host, store, reproduce, adapt, translate, modify, and display Your Content as reasonably necessary to provide the Service to you and to operate, secure, and improve the Service. This license also includes the right to use Your Content to develop, train, evaluate, and refine our own AI coaching models, prompts, datasets, retrieval systems, and related AI infrastructure. The license includes the right to sublicense to our service providers solely for the purposes above.
We do not send Your Content to third-party AI providers for them to train their own foundation models. Training rights granted under this section apply to AIDSTATION's own models, prompts, and datasets.
This license is personal-account scope with respect to the live copy of Your Content: it ends when Your Content is deleted from your account or when your account is closed, except for (a) AI models, prompts, datasets, embeddings, and other system improvements that were trained on or derived from Your Content (these incorporate generalized learnings and do not retain identifiable copies of Your Content), (b) anonymized or aggregated derivatives, (c) backup copies during normal backup rotation, and (d) records we are required to retain by law, all as described in our Privacy Policy section 7.
Where sensitive personal data (as defined in our Privacy Policy) is used for AI model training, we apply additional safeguards including de-identification or aggregation before training inputs leave the production environment, and we do not include sensitive categories in training without the same opt-ins that govern their collection.
The contractual license granted in this section operates alongside, and does not replace, the data-protection basis for the same processing described in our Privacy Policy (sections 4 and 7), which sets out the lawful basis, your opt-out, and the safeguards that apply. Where your local law requires consent for this processing, the license in this section does not override the need for that consent.
8.3 Crowdsourced facility data
If you contribute information to our shared facility, gym, or training-area database (descriptions, equipment lists, location details, photos that do not identify individuals), you grant AIDSTATION a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, sublicensable license to use that information as part of the Service and as part of any successor or anonymized derivative dataset. This license survives termination of your account because other athletes rely on this shared resource.
You may request removal or correction of specific entries you contributed and we will act on reasonable requests, but the license itself does not terminate on account closure.
8.4 Your responsibility for your content
You represent that:
- You own Your Content or have all rights necessary to grant the licenses above.
- Your Content does not infringe any third party's intellectual property, privacy, publicity, or other rights.
- Your Content does not contain personal data of other identifiable individuals other than coaches, training partners, or team members in their professional or athletic capacity, and that you have any necessary permissions for such information.
- Your Content complies with the Acceptable Use Policy.
We have the right (but not the obligation) to review, refuse, or remove Your Content for any reason consistent with these Terms and the Acceptable Use Policy.
8.5 Feedback to the AI
Prompts and feedback you submit to the AI coach become inputs to your account and to our system improvement process. We do not retain raw conversation transcripts; we do retain parsed coaching notes and structured outputs as described in our Privacy Policy.
8.6 Copyright complaints (DMCA)
We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
How to submit a notice. If you believe content on the Service infringes your copyright, send a notice to our Designated Agent. The notice must comply with the requirements of 17 U.S.C. § 512(c)(3). The current Designated Agent contact, the required notice contents, and a notice template are published at aidstation.pro/dmca. Notices sent elsewhere may not be timely received.
Counter-notification. If your content was removed in response to a DMCA notice and you believe the removal was in error or the use is otherwise authorized, you may submit a counter-notification under 17 U.S.C. § 512(g). The current counter-notification procedure and template are published at the same DMCA page.
Repeat-infringer policy. AIDSTATION terminates the accounts of users determined to be repeat infringers in appropriate circumstances, as required by 17 U.S.C. § 512(i)(1)(A). Determination is at AIDSTATION's discretion, based on factors AIDSTATION considers relevant in light of the circumstances. The published policy statement and the factors considered are available at aidstation.pro/dmca; AIDSTATION's internal application of those factors is not published and is not part of the user-facing commitment.
Misrepresentations. Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed in error, may be liable for damages. AIDSTATION reserves the right to seek recovery of any such damages, including costs and attorneys' fees, against parties who submit false or abusive notices or counter-notifications.
Non-U.S. copyright claims. If you are submitting a claim under a copyright framework other than U.S. law (for example, the EU Copyright Directive or its national implementations), you may use the same Designated Agent address as a point of contact. AIDSTATION will handle non-U.S. claims under the applicable law and its internal procedures. The § 512 process described above is specific to U.S. copyright law and does not by itself satisfy parallel obligations under other frameworks.
Other infringement claims. Trademark, right-of-publicity, defamation, and other non-copyright claims about content on the Service are not handled under the DMCA process. For non-copyright complaints, contact us at help@aidstation.pro; we will handle them under our standard content rules and applicable law.
Team features.
The Service offers team-based training in which team members coordinate their plans toward a shared race or training goal. Teams are athlete-to-athlete only; the Service does not provide a human-coach role.
- What teammates see: Members of your team can see your training plan. They cannot see your account profile, contact details, sensitive opt-in data (heart rate, sleep, body composition, GPS routes, injury history, or medical conditions), or any other personal information beyond the plan itself.
- Joining a team: Joining requires your affirmative action (accepting an invitation). You can leave a team at any time, at which point your plan is no longer shared with that team going forward.
- AI as coordinator: Coordinated team plans are generated by the AI coaching system using the same engine that produces individual plans, adapted for shared targets, mixed disciplines, and the constraints common to multi-athlete teams. There is no human coach role within the Service.
- Disagreement: If your plan within a team conflicts with what suits you, you may modify your plan or leave the team. The AI coaching layer continues to be available to you outside the team relationship.
- Coaches you work with outside the Service: Many athletes work with personal coaches. Any relationship with a coach outside the Service is between you and that coach. AIDSTATION is not a party to that relationship and does not provide accounts, tools, or features for human coaches. Any information you choose to share with an outside coach (for example, by exporting your plan and sending it to them) is your choice and your responsibility.
Integrations.
You may connect AIDSTATION to third-party services such as fitness device platforms (Garmin, Strava, Wahoo, Whoop, Apple Health, Samsung Health, and others), payment processors, calendar systems, and similar tools.
- Your relationship with the third party is governed by their terms and privacy policy, not by these Terms.
- You authorize data flow. Connecting an integration authorizes AIDSTATION to receive data from, and where applicable send data to, that service. You can disconnect at any time.
- No warranty. We do not warrant any third-party service. If a third-party service is unavailable, changes its API, or revokes our access, the corresponding integration in the Service may stop working without prior notice.
- Data handling on disconnect. When you disconnect an integration, we stop receiving new data from it. Previously received data remains in your account and continues to be governed by our Privacy Policy.
Acceptable use.
You agree to use the Service only for lawful purposes and consistent with these Terms and the Acceptable Use Policy (which we may refer to as the "AUP"). Without limiting the AUP, you will not:
- Share your account or attempt to use another person's account
- Use the Service to provide a competing service or to train a competing AI system
- Scrape, harvest, or systematically extract data from the Service
- Reverse engineer, decompile, or attempt to extract the source code, prompts, models, or training data of the Service
- Interfere with the Service's operation or security
- Submit malicious code, attempt unauthorized access, or probe for vulnerabilities without our written authorization
- Impersonate any person or misrepresent your affiliation with any person or entity
- Use the Service to harass, threaten, defame, or harm any person
- Use the Service in violation of any law, including export control and sanctions laws
- Use the Service for medical decision-making in lieu of consulting a qualified professional
Violation of the AUP can result in suspension or termination under section 14.
Our intellectual property.
The Service, including its software, design, content (other than Your Content), models, prompts, exercise libraries, sport rule sets, and underlying data structures, is owned by AIDSTATION or its licensors and is protected by intellectual property laws.
We grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal training or, where applicable to your subscription, your professional coaching of athletes who have their own accounts. This license is conditional on your continued compliance with these Terms.
You may not use our trademarks, logos, or brand assets without our prior written permission. The names of races, events, sports federations, devices, and third-party platforms referenced in the Service belong to their respective owners and are used for identification only.
Feedback.
If you send us suggestions, ideas, bug reports, or other feedback about the Service, you grant us a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use that feedback for any purpose without obligation to you. You waive any moral rights in such feedback to the extent permitted by law.
Suspension and termination.
14.1 By you
You may stop using the Service or close your account at any time. Closing your account ends your subscription at the end of the then-current billing period and triggers the deletion procedures described in the Privacy Policy.
14.2 By us
We may suspend or terminate your access to all or part of the Service if:
- You materially breach these Terms or the AUP
- Your account shows signs of fraud, security compromise, or unauthorized access
- A payment fails and is not resolved after notice
- A regulator, court order, or applicable law requires us to do so
- Your continued use of the Service poses a serious risk to other users, our systems, or third parties
Where reasonable, we will give notice and an opportunity to cure before suspension or termination. Where the situation does not allow notice (security incidents, legal requirements, ongoing harm), we may act immediately.
14.3 Effect of termination
On termination, your right to use the Service ends. The following sections survive: 5.2, 6, 8.2 (to the extent of the post-deletion derivative/model rights stated there), 8.3 (crowdsourced data license), 12, 13, 16, 17, 18, 19, 20, and any other provisions that by their nature should survive.
14.4 Refunds on termination
If we terminate your account other than for cause, we will refund any prepaid amounts for service periods after the termination date. If we terminate for cause (material breach, fraud, AUP violation), no refund is due.
Changes to the service.
We may add, modify, or discontinue features of the Service at our discretion. We will provide reasonable notice of changes that materially reduce functionality you actively use. If we discontinue the Service entirely, we will provide at least 60 days' notice, give you the ability to export your data, and refund any prepaid amounts for service periods after discontinuation.
Disclaimers.
Limitation of liability.
To the fullest extent permitted by law:

Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability for gross negligence, fraud, willful misconduct, or for death or personal injury caused by our negligence where the law prohibits such exclusion.
Allocation of risk
Indemnification.
You agree to defend, indemnify, and hold harmless AIDSTATION and its officers, directors, employees, contractors, agents, and licensors from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) Your Content; (b) your breach of these Terms or the AUP; (c) your violation of any law or any third party's rights; or (d) your use of the Service in a manner not authorized by these Terms.
We may, at our discretion, assume the exclusive defense and control of any matter for which you are required to indemnify us, in which case you will cooperate with our defense.
Governing law.
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
For any matter not subject to arbitration under section 20, the state and federal courts located in Johnson County, Texas have exclusive jurisdiction and venue, and you and AIDSTATION consent to personal jurisdiction there. This venue selection does not override a non-waivable right you may have under local consumer law to bring a claim in your home jurisdiction.
If you live in a jurisdiction whose consumer protection law requires application of its own law to your relationship with us, that consumer protection law applies to the extent it grants you greater protection.
Dispute resolution.
This section affects your legal rights. It requires individual arbitration of most disputes and includes a class action waiver. You can opt out within 30 days of creating your account (section 20.4).
20.1 Informal resolution first
Before filing arbitration or court action, you agree to contact us at help@aidstation.pro and describe the dispute. We will work in good faith to resolve it informally for at least 60 days. Many disputes can be resolved this way.
20.2 Binding arbitration
If the dispute is not resolved informally, you and AIDSTATION agree to resolve it by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, conducted by a single arbitrator. The arbitration will take place in the county in which you reside, by telephone or video unless the arbitrator orders otherwise, and the arbitrator's decision will be final and enforceable in any court of competent jurisdiction. If the AAA is unavailable or unwilling to administer the arbitration, the parties will select a comparable arbitration provider by mutual agreement, or failing agreement, the arbitration will be administered by JAMS under its Streamlined Arbitration Rules.
20.3 Class action and jury trial waiver
You and AIDSTATION each waive any right to a jury trial and to participate in a class action, collective action, or representative action against the other, except where such waiver is prohibited by law. The arbitrator may not consolidate more than one person's claims or preside over any form of representative or class proceeding.
20.4 Opt-out of arbitration
You may opt out of section 20.2 (Binding Arbitration) and 20.3 (Class Action Waiver) by sending a written opt-out notice to help@aidstation.pro within 30 days of first accepting these Terms. The notice must include your name, account email, and a clear statement that you opt out of arbitration. Opting out will not affect any other part of these Terms.
20.5 Exceptions
The arbitration agreement does not apply to:
- Claims for injunctive or equitable relief by either party for unauthorized use or infringement of intellectual property
- Small claims court actions, which either party may bring on an individual basis
- Disputes that applicable law prohibits from being arbitrated
20.6 Mass and coordinated filings
If 25 or more demands for arbitration are filed against AIDSTATION by or with the same or coordinated counsel, raising similar claims, the demands will be administered in coordinated batches under the arbitration provider's mass-arbitration procedures (where available). Fees and timelines may be adjusted accordingly. This provision is intended to ensure fair and orderly resolution and not to deny any individual's right to pursue their claim.
20.7 Survival
This section 20 survives termination of these Terms.
International users.
21.1 European Economic Area and United Kingdom
- Nothing in these Terms limits your statutory rights as a consumer under the laws of the country where you reside.
- The 14-day right of withdrawal under the EU Consumer Rights Directive (2011/83/EU) and equivalent UK law applies to new subscriptions involving digital content, except where you have expressly consented to immediate performance and acknowledged loss of the right of withdrawal at the time of purchase.
- Disputes may be submitted to the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
21.2 California residents
- As noted in section 7.3, California Business and Professions Code section 17600 et seq. applies. You may cancel at any time from account settings or by contacting us at help@aidstation.pro.
- The arbitration and class waiver provisions in section 20 do not waive any non-waivable rights under California law.
21.3 Quebec (Canada)
- Where required by Quebec law, the parties confirm that they have requested that these Terms and all related documents be drafted in English. Les parties confirment qu'elles ont demandé que les présentes Conditions ainsi que tous les documents qui s'y rapportent soient rédigés en anglais.
- The arbitration provisions in section 20 do not apply to consumer contracts to the extent prohibited by the Consumer Protection Act (Quebec).
21.4 Australia and New Zealand
- Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or the New Zealand Consumer Guarantees Act that cannot lawfully be excluded.
21.5 Other jurisdictions
Where local mandatory consumer protection law applies and conflicts with these Terms, the local mandatory law controls to the extent of the conflict. The rest of these Terms continues in effect.
App store additional terms.
If you access the Service through Apple's App Store, Google Play, or another platform, the following additional terms apply between you and us. They are required by the platform operator and you agree to them as part of these Terms.
22.1 Apple App Store
- These Terms are between you and AIDSTATION, not between you and Apple. Apple is not responsible for the Service or its content.
- Apple has no obligation to provide maintenance or support for the Service.
- If the Service fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no further warranty obligation regarding the Service.
- Product claims, including product liability, consumer protection, and intellectual property claims, are AIDSTATION's responsibility, not Apple's.
- Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them.
22.2 Google Play
- These Terms are between you and AIDSTATION, not between you and Google.
- The distribution of the Service through Google Play is subject to Google's terms.
22.3 General platform compliance
You agree to comply with all applicable platform terms (Apple Media Services Terms, Google Play Terms of Service, and equivalents).
Force majeure.
Neither party is liable for any delay or failure to perform caused by events beyond reasonable control, including natural disasters, war, terrorism, civil unrest, labor disputes, government action, internet or telecommunications failures, pandemics, and cyberattacks, provided that the affected party takes reasonable steps to mitigate. This section does not excuse payment obligations.
Assignment.
You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, reorganization, or sale of assets, and to any of our affiliates, on notice to you.
Notices.
- Notices to you will be given by email to the address on your account, by in-app notification, or by posting on the Service. You are responsible for keeping your email address current.
- Notices to us must be sent to help@aidstation.pro (with a copy by postal mail to the address in section 28 for legally required notices).
Changes to these terms.
We may modify these Terms from time to time. When we make material changes, we will:
- Update the "Last updated" date at the top
- Notify you by in-app notice and by email at least 30 days before the changes take effect (or sooner if a shorter notice is required by law, regulator, or to address a security or legal risk)
- Where required by law, request your renewed consent
If you do not agree to the updated Terms, you may close your account before the changes take effect. Continuing to use the Service after the effective date constitutes acceptance of the updated Terms.
For purposes of section 20 (Dispute Resolution), the 30-day opt-out period restarts only when we make material changes to that section specifically.
Miscellaneous.
- Entire agreement. These Terms, together with the Privacy Policy, Cookie Policy, Acceptable Use Policy, and any other policies referenced in the Service, are the entire agreement between you and AIDSTATION regarding the Service and supersede all prior agreements.
- Severability. If any provision of these Terms is found unenforceable, the remaining provisions continue in effect.
- No waiver. Our failure to enforce any provision is not a waiver of that provision.
- No third-party beneficiaries except as expressly stated (see section 22.1 for Apple).
- Headings are for convenience only and do not affect interpretation.
- English controls. These Terms are written in English. Translations are provided for convenience. The English version controls in case of conflict, except where local law requires otherwise.
- No agency. Nothing in these Terms creates an agency, partnership, joint venture, or employment relationship between you and AIDSTATION.
